Terms of service

Last updated 2026-10-13

In short

  • FITIT gives general fitness information, not medical advice. Check with a health professional before you start, and stop if something hurts.
  • Premium renews automatically until you cancel, and you can cancel any time from Settings.
  • You own your data. You can download it or delete your account whenever you want.

This summary is a convenience. The full text below is what applies.

1. Agreement and who can use FITIT

These terms are an agreement between you and QSMART LTD. about your use of FITIT, including the website and any apps or features we offer. By creating an account or using FITIT you agree to them and to our Privacy Policy.

You must be an adult in the place where you live, or have the permission and supervision of a parent or guardian. FITIT is not intended for children under 16.

2. Health and safety: not medical advice

FITIT provides general fitness information and workout programs for healthy adults. It is not medical advice and does not replace a doctor, physiotherapist or qualified trainer. Exercise carries a risk of injury.

  • Talk to a doctor before starting if you have a medical condition, are pregnant or recovering, are taking medication that affects exercise, or have been inactive for a long time.
  • Choose weights and intensity that suit you, warm up, and stop immediately if you feel pain, dizziness, chest discomfort or shortness of breath. In an emergency, call your local emergency number.
  • Programs and exercises are general. They are not tailored to your body or condition, and exercise form can differ from what is described. Consider learning technique, especially for barbell lifts, with a qualified coach.
  • Numbers you log, such as body weight or measurements, are entered by you and are not medical measurements. FITIT does not estimate calories burned or diagnose anything.

You use FITIT and follow any workout at your own risk and are responsible for exercising within your abilities.

3. Your account

  • Give accurate information and keep it up to date. One account per person.
  • Keep your password and sign-in methods secure. You are responsible for activity on your account. Tell us promptly if you think someone else has accessed it.
  • You can delete your account at any time in Settings. We can suspend or close an account that breaks these terms or puts the service or other people at risk.

4. Our content and your content

The programs, exercises, text, design and images in FITIT belong to us or our licensors. We give you a personal, non-exclusive, non-transferable right to use them for your own training. You may not copy, resell, scrape or republish them without our written permission.

People shown in some images are fictional and AI-generated. They are not real trainers or customers, and nothing on FITIT is a customer testimonial.

The information you enter (your profile, preferences, workouts and measurements) is yours. You give us permission to store and process it only to provide FITIT to you, as described in our Privacy Policy.

5. Premium subscriptions and payment

FITIT has a free plan and a paid Premium plan. The price, billing period (monthly or yearly) and any taxes are shown before you pay. Prices are shown in USD unless checkout says otherwise.

  • Payments are processed by Stripe. We never see or store your card number.
  • Premium renews automatically at the end of each billing period at the then-current price until you cancel. We will tell you in advance if the price changes, and the change applies from your next renewal.
  • Cancel any time in Settings under “Manage billing”. You keep Premium until the end of the period you paid for and are not charged again.
  • If a payment fails, Stripe retries it for a period and you keep access while it does. If it ultimately fails, your plan returns to Free.
  • Premium access is granted only after Stripe confirms your payment.

Refunds: Except where the law requires otherwise, payments are not refundable once a billing period has started. If you were charged by mistake or something went wrong, write to us and we will review it fairly. Nothing in this section limits rights you have under consumer protection law.

6. Acceptable use

Do not:

  • access, or try to access, another person's account or data, or probe or test the security of the service;
  • interfere with the service, overload it, or use bots, scrapers or automated tools to extract content;
  • upload anything unlawful or harmful, or content you do not have the right to use;
  • use FITIT to give medical advice or to present our content as your own;
  • share your account, or use the service in breach of the law.

7. Third-party services

FITIT relies on services from others, including Google (sign-in, database, hosting), Stripe (payments), Brevo (email), and Google or Facebook if you choose them to sign in. Their own terms and privacy policies apply to what they do, and we are not responsible for their services.

8. Availability and changes

We work to keep FITIT available but do not promise it will always be uninterrupted or error-free. We may change, add or remove features, programs and content, and may update the free and Premium offerings. If we remove a paid feature in a way that materially reduces what you paid for, we will treat that fairly.

9. Disclaimers and limits on liability

FITIT is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim warranties of any kind and are not liable for indirect, incidental or consequential losses, or for injury or loss that results from following a workout or from your use of the service.

To the fullest extent the law allows, our total liability to you for any claim related to FITIT is limited to the greater of the amount you paid us in the 12 months before the claim and USD $50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for fraud, death or personal injury caused by our negligence where the law does not allow that exclusion, or your statutory consumer rights.

10. Changes to these terms

We may update these terms. For changes that matter, we will give you at least 30 days' notice by email or in the app before they take effect. If you keep using FITIT after the changes take effect, you accept them; if you do not agree, you can delete your account.

11. Governing law and disputes

These terms are governed by the laws of Ontario, Canada, excluding conflict-of-law rules. If we cannot resolve a dispute by talking, it will be decided by the courts of that place, except that you may also have the right to bring a claim where you live under local consumer protection law.

12. General

These terms and our Privacy Policy are the whole agreement between us about FITIT. If a part is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer your account or these terms to someone else; we may transfer ours as part of a sale or reorganisation of the business.
